Legal Restrictions & Penalties

The Golden Visa program offers significant freedom and benefits, but it comes with specific restrictions designed to ensure properties are used appropriately. Violating these rules can result in steep penalties — including loss of your residence permit.

1.

Short-Term Rentals Are Not Allowed

Golden Visa properties cannot be rented on short-term platforms like Airbnb or Booking.com. This applies to all properties acquired under the Golden Visa program for both personal and investment use.

Penalty:

  • €50,000 fine for listing or subletting a property for short-term rental purposes
  • Repeated offenses may result in revocation of the residence permit

Commercial Use Is Prohibited

You cannot use the property for:

  • Retail stores
  • Office spaces
  • Business headquarters
 (unless it is explicitly permitted under a separate arrangement or law)

Penalty:

  • Immediate disqualification from the program
  • Loss of permit and additional fines

Restoration Properties Have Strict Timelines

If you qualify for the Golden Visa under the €250K restoration category (e.g. heritage or listed buildings), you must complete the restoration within the initial 5-year permit period.

Penalty:

  • €150,000 fine if restoration is not completed
  • No renewal of residence permit

Transfers Before Completion Are Prohibited

Properties bought under the €250K renovation category cannot be sold or transferred until full restoration or reconstruction is completed.

Any contract signed to transfer an incomplete project will be legally null and void.

Other Key Restrictions

No use as business branches or offices (especially for converted or restored properties)

Minimum size and value thresholds must be maintained for renewals

Border zone properties may require special permits
